Terms of Service

These Terms govern the free test version of emaia.eu, an experimental service for hosted mailboxes, inbound and outbound email, transactional email APIs, form submissions, delivery visibility, and related administration.

Operator and Contact

emaia.eu is currently operated privately by Boban Acimovic. No company is presently the operator or contracting party. The service is offered to private persons and organizations during a free test period.

Acceptance

By creating an account or using the service, you accept these Terms. If you act for an organization, you confirm that you may bind it. An authorized organization owner or administrator must accept each combined Terms and Privacy version for the organization. Transactional email sending and creation of new read_write API tokens require current effective acceptance; read access remains available as specified. The test service is free until a future price and paid terms are presented and expressly agreed; registration does not authorize automatic charges. If you do not accept these Terms, do not use the service.

Accounts and API Tokens

Provide accurate contact and account information, keep mailbox passwords, login sessions, and API tokens confidential, and use appropriate access controls for your organization. API tokens, including Mailgun-compatible credentials, authorize activity for your organization. You are responsible for activity authorized through your credentials and must promptly report suspected misuse. Keep independent copies of important messages, configuration, and other data.

Acceptable Use

Do not use the service for unsolicited or unlawful advertising, spam, phishing, malware, credential harvesting, deceptive or forged sender identities, harassment, illegal content, infringement of third-party rights, unauthorized access, or attempts to evade technical or usage limits. Do not interfere with the security, integrity, availability, reputation, or lawful operation of the service, connected systems, or other users.

Sender Responsibility

You must control or be authorized to use every domain, mailbox, sender identity, recipient list, API integration, and SDK configuration you configure. You are responsible for message content, DNS configuration, required notices, consent and other legal bases, marketing, ePrivacy and telecommunications rules, recipient requests, and the lawfulness of receiving, storing, forwarding, or sending email. Successful acceptance or delivery is never guaranteed.

Availability and Early-Stage Limits

emaia.eu is a free, actively developed test service provided as available, without a service-level agreement or promises of uninterrupted operation, successful delivery, storage duration, recovery, capacity, support response, or continued availability. Features, limits, infrastructure, and retention may change; maintenance, Internet failures, third parties, abuse controls, and security events may interrupt service. Use it at your own risk and not for business-critical, safety-critical, legally required, highly sensitive, or sole-copy communications.

Suspension and Termination

We may reject, filter, quarantine, rate-limit, suspend, or terminate accounts, domains, mailboxes, messages, or integrations when reasonably necessary for abuse prevention, security, deliverability, legal compliance, maintenance, or platform protection. Urgent action may be immediate; otherwise we will try to give reasonable notice when practicable. You may stop using the service at any time. After termination, data may be deleted following a reasonable operational period, subject to legal, security, dispute, and backup requirements.

Intellectual Property and Feedback

You retain rights and responsibility for your domains, messages, and other content. You grant only the rights needed to receive, store, scan for abuse or malware, route, transmit, back up, and otherwise process that content to operate and secure the service. Rights in the service, software, documentation, branding, and operational systems remain with their respective owners. Feedback may be used without payment or obligation.

Disclaimers and Liability

To the maximum extent permitted by law, the free test service is provided as available without contractual warranties concerning availability, delivery, deliverability, retention, recovery, compatibility, security, or fitness for a particular purpose. Mandatory statutory rights and liability remain unaffected, including liability for intent, gross negligence, injury to life, body, or health, and any other liability that cannot lawfully be excluded or limited. Outside mandatory liability, no responsibility is accepted for indirect or consequential loss, lost profit, lost data, failed delivery, or business interruption.

Language and Translations

Translations are provided for convenience and may be automated or machine-assisted. If wording is unclear, contact us. If translated text conflicts with English text, the English version controls unless a separate signed agreement says otherwise.

Changes

We may update these Terms and the Privacy Policy as the test service, legal requirements, or operating model changes. For ordinary material changes, publication and queueing of the notification email start a grace period of at least seven days before the new version takes effect, and we will request acceptance of the combined version. Urgent legal, security, or abuse-related changes may take effect immediately when reasonably necessary. A new version applies prospectively from its stated effective date; if you do not agree, stop using the affected service. A future paid service will require separate pricing information and express agreement.
